1. INTRODUCTION AND ACCEPTANCE
a) These Terms of Use ("Terms") constitute a legally binding agreement between You (the "User") and Tatva Fintech Private Limited ("Company," "We," "Us"), operating the brand and platform TatvaMoney.
b) By accessing or using the website https://www.tatvamoney.com, You accept these Terms in full. If You disagree with any part of these Terms, You must discontinue use of the Website immediately.
2. SERVICES AND ROLE OF COMPANY
a) Facilitator Role: TatvaMoney acts solely as a Corporate Direct Selling Agent (DSA) and technology bridge. We connect borrowers with third-party lenders (Banks/NBFCs).
b) No Lending Activity: We are not a Bank, NBFC, or Lender. We do not approve loans, accept deposits, or set interest rates.
c) Loan Decisions: All decisions regarding loan sanction, rejection, interest rates, tenure, and processing fees are at the sole discretion of the respective partner Bank/NBFC. We have no influence over these decisions.
3. ELIGIBILITY
You represent and warrant that:
a) You are at least 18 years of age.
b) You are a resident of India.
c) You are competent to enter into a binding contract under the Indian Contract Act, 1872.
4. USER OBLIGATIONS
You agree to:
a) Provide true, accurate, current, and complete information during the application process.
b) Not upload any content that is false, misleading, defamatory, obscene, or infringing on intellectual property rights.
c) Not use any automated means (bots, scrapers) to access the Website.
d) Not attempt to breach the security or authentication measures of the Website.
5. CONSENT TO CONTACT
By registering on TatvaMoney, You explicitly authorize Us and our partner lenders to contact You via Phone Call, SMS, WhatsApp, or Email regarding Your loan application and related financial products. This consent overrides any registration You may have with the DND (Do Not Disturb) or NCPR registry.
6. FEES AND CHARGES
a) Service Fee: TatvaMoney generally provides its advisory services to customers free of charge, as we are compensated by our partner institutions.
b) Lender Charges: You are responsible for paying any processing fees, legal fees, valuation charges, or stamp duties levied directly by the Bank/NBFC.
c) We reserve the right to introduce fees for specific premium services in the future, with prior notice.
7. LIMITATION OF LIABILITY
a) No Warranty: The services are provided on an "as-is" basis. We do not guarantee that Your loan will be approved.
b) Third-Party Actions: The Company shall not be liable for any damages or losses arising from the rejection of Your application, delay in disbursement, or the terms offered by the partner Bank.
c) Technical Issues: We are not liable for any loss of data or service interruption due to technical failures, maintenance, or force majeure events.
8. INTELLECTUAL PROPERTY
All content on this Website, including the "TatvaMoney" logo, text, graphics, software, and code, is the exclusive property of Tatva Fintech Private Limited and is protected by Indian copyright and trademark laws. Unauthorized use, reproduction, or distribution is strictly prohibited.
9. INDEMNITY
You agree to indemnify and hold harmless the Company, its directors, employees, and agents from any claims, losses, damages, or legal fees arising out of Your violation of these Terms, Your misuse of the Website, or Your provision of false information.
10. DISPUTE RESOLUTION
In the event of any dispute arising out of these Terms:
a) Mediation: The Parties shall first attempt to resolve the dispute amicably through mutual discussion within 30 days.
b) Arbitration: If mediation fails, the dispute shall be referred to a sole arbitrator appointed by the Company. The arbitration shall be conducted in English.
c) Seat of Arbitration: The seat and venue of arbitration shall be Pune, Maharashtra.
11. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of India. The courts at Pune, Maharashtra shall have exclusive jurisdiction over all matters concerning these Terms.
